18 States Offer In-State Tuition For Illegals... And Legal Residents Are Not Happy About That

The Eleventh Circuit U.S. Court of Appeals ruled that colleges in Georgia are not required to admit illegal immigrant students. 

The decision further sparked a national conversation about the rights of Dreamers, as well as the legality of offering them in-state tuition benefits, which usually allow students attending college in their home states to pay far less than their peers from different states.

Citing US Code 1623, which states that anyone who is not legally a citizen cannot be entitled to any benefit that is denied to a citizen of the United States, some have questioned whether those here illegally should be offered in-state tuition rates that aren’t available to other students who are citizens. Currently, 18 states, offer some form of a pathway for in-state tuition to those living here illegally.

According to the National Conference of State Legislatures, 18 stateCalifornia, Colorado, Connecticut, Florida, Illinois, Kansas, Maryland, Minnesota, Nebraska, New Jersey, New Mexico, New York, Oregon, Texas, Utah, and Washington — offer in-state tuition to illegal immigrant students. Two more states — Oklahoma and Rhode Island — offer in-state tuition to illegal immigrant students, pending approval from the Board of Regents. 

So, what do college students think?

Is it fair for those who are here illegally to have access to in-state tuition? Campus Reform spoke to students all day at the University of Nevada- Las Vegas, and not one student said that doesn’t seem right.

“Why do they get to pay less when I’ve got to pay more?” one student said…

…while another added, “What do you get for living here all your life legally instead of coming here illegally? I just don’t think that’s fair.”

Another student echoed that sentiment, saying, “that’s disappointing because I did quite a bit to earn my college.”

One of these were FHA loans.

Democrat abuse of the FHA helped lead to the Great Recession and in the years afterward, FHA insured loans hit losses of $70 billion. By 2012, the FHA was $16 billion in the hole and had to be bailed out. The delinquency rate for FHA loans is still more than three times higher than normal loans, and depending on the period, have hovered between 8% and 14%. Time to bring in the illegal aliens.

When Obama illegally implemented DACA, a program exempting certain illegal aliens from government action, they were also allowed to apply for FHA loans. How many illegal aliens obtained FHA loans?

In December, a letter from three Senate Democrats claimed that HUD barred “approximately 800,000 individuals approved for DACA from FHA-insured mortgage loans”. This refers to the total number of DACA illegal aliens and it’s unknown how many of them have obtained FHA loans in past years.

Ellie Mae’s millennial tracker estimated that the average size of an FHA loan to millennials is $186,454. Potential exposure to illegal alien mortgages could then climb as improbably high as $150 billion.

It’s unknown how many illegal aliens have taken out FHA loans, but some media stories have cited loan officers for whom illegal alien FHA loans represent a significant percentage of their business.

The Trump administration has applied the brakes to this avalanche of taxpayer-insured mortgages to illegal aliens. The Department of Housing and Urban Development (HUD) had begun notifying lenders that the FHA was no longer in the illegal alien mortgage business. The reasons were common sense. DACA illegal aliens, or in media spin, DREAMERs, were not legal residents and weren’t being legalized.

Under Obama, FHA rules had been bent so far backward that people who were not only non-citizens, not only non-permanent residents, but weren’t even legally here, were having taxpayers guarantee their mortgages. Not only hadn’t the Democrats learned anything from the Great Recession, they were determined to make the irresponsible behavior of the FHA a decade ago seem sober and sensible.

And they aren’t giving up.

The December letter by Senator Menendez, who had recently been on trial for corruption charges, Senator Booker, on whose watch the $100 million poured into Newark public schools dissipated, and Senator Cortez-Mastro, who had been accused of taking dirty money, claimed to be, “appalled that the Trump Administration would exploit a federal government program to deny Dreamers an opportunity of owning their own home.” But it was the Democrats who had exploited a federal government program meant for poor Americans to benefit not only foreigners, but illegal aliens with no right to be here.

The letter by the three Senator Democrats falsely claimed that President Trump was targeting a “portion of the American public”, when in fact illegal aliens are not part of the American public. They demanded, “sound and unambiguous legal reasoning” for the move. The sound and unambiguous reasoning would be that illegal aliens are not legally resident in the United States and therefore do not qualify for loans.

Much of the furor over FHA loans for illegal aliens was stirred up by Dani Hernandez, an underwriter for NewCastle Home Loans. NewCastle in Chicago markets aggressively to DACA illegal aliens, declaring, “Don’t let the political climate worry you. DACA recipients are eligible to buy a home.” It also assures the illegal aliens that they can qualify for FHA loans and it “specializes in working with DACA recipients.”

Prospective FHA borrowers are also informed that they can get a loan with a credit score as low as 500 and a 50% debt-to-income ratio.

The illegal alien mortgage business, built on the backs of American taxpayers, is obviously profitable. But it’s also a silent nuclear weapon threatening mass destruction of the economy in case of deportations.

The more illegal aliens end up with FHA loans, and as those FHA loans are turned into Ginnie Mae Mortgage Backed Securities, deporting DACA illegal aliens would risk mass defaults on FHA loans which are backed by American taxpayers. Quite a few Ginnie Mae bonds are being held by Japan and China.

That’s why HUD’s move of stopping the flow of FHA loans to illegal aliens is so vital and important.

Not only do FHA loans endanger our economic security, they also endanger our national security. Their very existence serves as political leverage to prevent the government from enforcing the law. Every illegal alien mortgage not only robs American taxpayers, but puts them at risk of even worse losses.

And considering the role of mortgage backed securities in the Great Recession, the threat is real.

However, HUD has carefully avoided taking a clear position to prevent the inevitable lawsuits and overrides by Obama and Clinton judges embedded in the federal judiciary. Instead HUD officials have successfully warned off many lenders by creating ambiguity about the status of DACA FHA loans.

The riskier illegal alien FHA loans appear, the more irresponsible taking them on will seem. And lenders will be aware of the shadow of the “False Claims Act” hanging overhead if they bite on illegal loans.

This is far from an ideal solution. But it’s an understandable response by a crippled executive branch that has had its legal powers stripped from it by Democrat activists operating under the guise of judges.

But taxpayer-backed mortgages for illegal aliens are only the tip of the tottering FHA iceberg that President Trump needs to begin shutting down to avoid another recession caused by bad loans.

FHA loans to non-citizens are also extended to non-permanent residents and even to “refugees”. The Office of Refugee Resettlement had even been promoting Freddie Mac’s Islamic Sharia-compliant mortgages for Muslim “refugees”. Foreigners here under Temporary Protected Status, a category that the Trump administration has begun winding down, are also potentially eligible for FHA loans.

The FHA is deeply dangerous and troubled. It is in desperate need of reform.

American taxpayers have long been exploited by the FHA as a piggy bank to pay off Democrat voters. But DACA FHA loans have taken this a step further by taking the economy hostage for illegal aliens.

The FHA loan was created to serve Americans. If it is to continue to exist, it should only serve Americans.

There has never been any reason given why the United States government should be extending its credit on behalf of foreigners, whether they are residents, temporary workers or, let alone, illegal aliens.

The risk of such loans has been rolled into the overall risk for Americans. And the buck was passed.

The artificial stimulation of the housing market isn’t reason enough for the government to be putting the economy at risk and taxpayers on the hook for the illegal aliens whom Democrats hope to turn into voters. DACA was an illegal policy. FHA loans for DACA recipients piles illegality on illegality.

American taxpayers should be let off the hook for illegal alien mortgages before the cost grows too high.

Dems announce expanded Dream Act…

House Democrats upped their ante on illegal immigration Tuesday, announcing new legislation that would not only grant legal status to potentially millions of illegal immigrant “Dreamers,” but adds hundreds of thousands of more migrants to the mix.

Dreamers would be eligible for in-state college tuition and taxpayer-backed financial aid, would get new protections against swift deportation, and would have a “direct” pathway to citizenship.

Even some already-deported illegal immigrants would be allowed to apply to return under the bill, announced by House Speaker Nancy Pelosi and fellow Democrats in a rally at the Capitol.

“There should be nothing partisan or political in this legislation,” Mrs. Pelosi said.

The bill goes beyond the Dream Act, legislation that’s been kicking around for nearly two decades, which would offer a path to citizenship to as many as 2 million illegal immigrants.

The updated version would also grant a pathway to citizenship to hundreds of thousands of people here under Temporary Protected Status or Deferred Enforced Departure.

Those are both types of humanitarian protections designed to give people a temporary safe place in the U.S. — along with work permits and some other taxpayer benefits — while their home countries recover from natural disasters, instability or wars.

Yet over the decades, those protections have become semi-permanent. The average TPS holder has been in the U.S. 20 years at this point.

Democrats said they’ve put down roots, and asking them to return now is unfair.

“We are not going to let Donald Trump send them back, putting their lives in peril or tearing their families apart,” said Rep. Nydia Velazquez, a New York Democrat.

She and fellow Democrats said those to whom they’re offering citizenship rights are already American in most ways, save for their illegal entry or continued iffy legal status.

Dream Act legislation has been on the cusp of passage before, clearing the House in 2010 but defeated in the Senate by a GOP filibuster that year.

Last year, President Trump floated several different deals that would have granted some more permanent legal status to Dreamers, but Democrats and some Republicans said he was asking for too much in return with his demand for border wall money, limits to family-based immigrant visas and an end to the visa lottery.

Those negotiations took place under a GOP-led Congress.

“We are in charge now,” Rep. Mark Takano, California Democrat, said Tuesday, underscoring why Democrats are optimistic they can win a legalization without also having to embrace Mr. Trump’s get-tough policies.

WALSH: Please Stop Killing Undocumented Infants Who Are Just Trying To Cross The Border Of The Birth Canal

The only difference between a baby moments before leaving the womb and a baby outside the womb is documentation. A birth certificate and Social Security card are issued to a child within a few weeks of birth.

This paperwork is necessary to make the child an official citizen of the United States, but they cannot actually confer biological personhood status. Personhood may be recognized by words on a page, but the words cannot make a person. Besides, I’ve been reliably informed that undocumented people are still people and deserve all of the same rights as those of us with documentation.

I’ve also been told many times that undocumented people have the right to cross through barriers and over borders in pursuit of life and liberty. Planned Parenthood even says that the undocumented “have the right to live.” I totally agree with this sentiment. All people have the right to live. And I certainly would not support summary execution of immigrants on the southern border. It’s fortunate that no one has ever suggested such a thing.

But there is, you might say, a different southern border that is quite often protected by violent means. Undocumented infants who are trying to cross the border of the birth canal in hopes of a better life are routinely stabbed, poisoned, crushed, and dismembered for doing so. The murder of these migrants is especially egregious because, unlike the type from Central America, they really have no choice but to leave their homeland. It is often insisted that migrants from Mexico and Guatemala are “forced” to leave because of conditions in their countries. Well, undocumented infants really are forced. They did not choose to be conceived in their womb of origin. They do not choose when and if they are born. They are victims of circumstance.

Immigrants deserve a chance. Isn’t that the slogan? They are “dreamers.” They are good people, decent people, just trying to survive. These are the lines, correct? Am I saying this right? Well it applies just as well to infants.

It is claimed that we are all undocumented immigrants. This is false, of course. Our ancestors, maybe, but not us. And even our ancestors may have come to this country legally, through Ellis Island. Or maybe they came back in settler and pioneer times, when there was no documentation thus no distinction between undocumented and documented. But it is true that we were all, at one time, undocumented infants. All of us began our existence in the womb. All of us were granted the opportunity to flee the womb and build a life for ourselves. Who are we to deny this right to the undocumented infants who come after us? It is the worst form of discrimination.

Democrats Preview Response to Trump Oval Office Speech: ‘There Is No National Emergency on the Southern Border’

Democrats have already dropped hints of what their response to President Donald Trump’s address Tuesday evening from the Oval Office on the border crisis will be.

The networks have granted Speaker of the House Nancy Pelosi (D-CA) and Senate Minority Leader Chuck Schumer (D-NY) airtime to respond. Their message will be that there is no crisis that merits building a barrier on the border. The only crisis, to them, is the partial government shutdown.

As Sen. Patrick Leahy (D-VT) said last week, responding to the suggestion Trump may declare an emergency so he can order the military to build the barrier: “There is no national emergency on the southern border.” He described the idea as “stealing resources from the Defense Department.”

The real solution to what he called the “complex issues at our southern border” — which are not an emergency, mind you — is “comprehensive immigration reform.”

The idea that there is no crisis at the border will be a tough sell, especially as Democrats and the media described the situation as a crisis last summer, when the Trump administration started enforcing its “zero tolerance” policy toward illegal crossings that resulted — thanks to existing rules dating to the Obama administration — in children being separated from adults. Pelosi even questioned “why there aren’t uprisings all over the country” about it.

To Democrats, the only “crisis” — aside from the government being partially closed for two weeks — results from the enforcement of existing laws at the border. To resolve that “crisis,” they want to pass more laws — which, they insist, include provisions for “border security,” though they do not want to enforce the laws already on the books.

Here are some other arguments Democrats will likely use, based on their statements over the past several days.

1. Trump is a liar. “I expect the president to lie to the American people,” said Rep. Jerrold Nadler (D-NY), the new chair of the House Judiciary Committee, during a visit to the border yesterday. (Nadler added: “There’s no security crisis at the border.”) Nadler echoed the CNN line, which is that the president’s speeches should not enjoy live coverage because he might say inaccurate things — a problem journalists never had with President Barack Obama.

2. Border walls and fences do not work. This is another weak argument, since many House and Senate Democrats — including Schumer — voted for the Secure Fence Act of 2006. Other variants of this argument is that a wall would be immoral (Pelosi) and racist (Rep. Alexandria Ocasio-Cortez (D-NY)). However, given examples of walls or fences to stop migrants in the European UnionIsrael, and even Botswana, these arguments are also easily defeated.

3. Trump’s $5 billion proposal is wasteful. This is a tough argument to sustain after Democrats’ own proposals to end the partial shutdown and re-open the government. Democrats want “over $12 billion more in foreign aid than the Trump administration requested,” according to Breitbart News’ Rebecca Mansour. Democrats also asked for a combined $10 billion in extra funding for the United Nations and other supposed priorities. $5 billion is nothing.

4. Mexico should be paying for it. Democrats have been taking potshots at the president for months by reminding him of his refrain from the campaign trail in 2016. Trump has argued that Mexico is paying for the wall through its concessions on trade. But the U.S. could also tax remittances Mexican workers in the U.S. send home, or raise fees for crossing the border. There are many ways to collect in future, if needed; what the wall needs is a down payment.

5. Government shutdowns are wrong. This used to be a winning argument for Democrats — until they shut down the government themselves last year in an effort to force President Trump and the Republicans to legalize the so-called “Dreamers,” i.e. illegal aliens brought to the country as minors. The contrast also works in favor of Trump: Democrats shut down the government to protect illegal aliens, while the president is doing so to protect Americans.

The fact is that the Democrats’ best and only case against the border wall is that Trump proposed it. They know if he fails to deliver on his core campaign promise, he will lose his voter base. And they know if he buckles and re-opens the government without the funding he wants, they can walk all over him for the next two years.

What they may not realize is those reasons also make him stronger: he cannot compromise, therefore he has the advantage.
