Broward election supervisor suspended following controversial recount

As signs build that Florida’s new governor may suspend Broward County’s elected sheriff from office, a federal judge has ruled that the state’s former governor overstepped when he effectively fired Broward County’s elections supervisor.

In a Wednesday evening order, U.S. District Court Judge Mark Walker found that Rick Scott exceeded his authority when, on the heels of a controversial election recount, he suspended Brenda Snipes from office. Due to the timing of her removal and her plans to resign in early January, Snipes was left without the ability to challenge her ouster or contest the allegations contained in Scott’s executive order.

Walker declined to reinstate Snipes, a 15-year veteran of the elections department, which she had sought in the form of a preliminary injunction. He also agreed that the Florida Senate was right to deny her a hearing that by law is typically afforded politicians who seek to challenge a suspension by the governor.

But he did order Scott’s successor, the newly elected Florida Gov. Ron DeSantis, to issue a new order by the end of the month explaining the reasons for Snipes’ suspension, and demand that Snipes be granted a special hearing before the governor no later than March 31.

“Judges face murky legal issues every day. Today is not one of those days,” wrote Walker, who has been critical of Scott in previous rulings. “Flagrantly disregarding [Snipes’] constitutional rights fits into an unfortunate rhythm for Scott.”

Walker, of Tallahassee, was explicit that he was not mandating an outcome that Snipes be reinstated and wrote that he was not aware “of any principle demanding such a remedy.” But he said that Snipes must have a forum to be heard.

A spokesman for Scott, who was sworn in as a U.S. Senator Tuesday, dismissed Walker as a “liberal judge” and said Scott “stands by his decision.” He pointed to a number of mistakes made by Snipes’ office during the 2018 recount of the governor’s race and Scott’s U.S. Senate race against Bill Nelson, and to past missteps involving the Broward elections office under Snipes. Snipes has been re-elected four times since being appointed in 2003.

“Supervisor Snipes violated state law and turned Broward County’s elections operation into a laughing stock,” said Scott spokesman Chris Hartline. “She failed to fulfill her duties, and for that she was suspended and should stay suspended.”

Still, though DeSantis has also been critical of Snipes — even alluding to botched elections in his inaugural speech — Walker’s ruling seems to leave the new governor to clean up the old governor’s controversy. Scott began the ordeal in November when he suspended Snipes less than two weeks after she announced plans to resign on Jan. 4.

A day after Scott suspended her, Snipes rescinded her resignation and said she would fight back against claims of incompetence and misconduct.

Scott immediately replaced her with his former general counsel, Pete Antonacci, which according to the Florida Senate sealed her resignation as irrevocable despite her subsequent reversal and attempts to fight to keep her job. That, Walker said, left Snipes no ability to properly contest the allegations that Scott made in removing her — some of which Walker said were erroneous.

Snipes’ attorney, Burnadette Norris-Weeks, said Wednesday night that the ousted supervisor’s legal team is pleased with Walker’s determination that Scott could not legally “vilify” Snipes without giving her a chance to respond (Walker was not taken by an argument from Scott’s attorney that Snipes could respond through the press.)

“Scott utilized numerous tactics to bully my client and apply standards to her that he did not apply to any other state Supervisor of Elections,” said Norris-Weeks. “We are looking forward to telling our complete story and we’re also encouraged that Judge Walker recognized that former governor Scott has a history of disregarding the legal rights of others…”

A DeSantis spokesman had no comment late Wednesday, but Walker’s ruling could complicate his apparent plans to suspend Broward Sheriff Scott Israel.

DeSantis has hinted that he’ll suspend Israel, whom he criticized on the campaign trail over the Broward Sheriff’s Office’s response to the massacre at Marjory Stoneman Douglas High School. DeSantis has suggested that he’s vetting replacements for Israel, and said Wednesday morning that he’ll “be back soon” in South Florida when asked if he was going to suspend Israel.

Jorge Ramos: Border Wall ‘Symbol of Hate and Racism’ for ‘Those Who Want to Make America White Again’

Univision anchor Jorge Ramos thinks President Donald Trump’s border wall would be nothing more than a “symbol of hate and racism” for “those who want make America white again.”

In a Wednesday New York Times op-ed, Ramos notes that Trump “is not the first president to ask for money for a wall.” He points out that former Presidents George H.W. Bush, Bill Clinton, and George W. Bush “built fences and walls along the southern border” while former President Barack Obama “maintained the resulting system of roughly 700 miles of physical barriers.”

“So why don’t we want Mr. Trump to build his wall? What is different?” Ramos asks. “The difference is that Mr. Trump’s wall is a symbol of hate and racism, it would be completely useless, and it does not address any national emergency.”

Ramos, who said the United States has a responsibility to “absorb” caravan migrants, says the fight against the border wall “is about more than just a wall.”

“The wall has become a metaphor to Mr. Trump and his millions of supporters,” he writes. “It represents a divide between ‘us’ and ‘them,’ a physical demarcation for those who refuse to accept that in just a few decades, a majority of the country will be people of color.”

Ramos accuses Trump of trying to “exploit the anxiety and resentment of voters in an increasingly multicultural, multiethnic society” with his promise of a border wall, which Ramos says is nothing more than “a symbol for those who want to make America white again.”

“The chant ‘Build that wall, build that wall’ became his hymn — and an insult not just to Latinos but also to all people who do not share his xenophobic ideals,” Ramos continues. “The wall went from a campaign promise to a monument built on bigoted ideas. That is why most Americans cannot say yes to it. Every country has a right to protect its borders. But not to a wall that represents hate, discrimination and fear.”

He concludes by arguing that Trump “is the wall” because “the concept of America as an unwelcoming country to immigrants and uncomfortable for minorities is already here.”

‘More truth’? Second cache of 9/11 docs released by Dark Overlord hackers

The Dark Overlord hacker group has released decryption keys for a second batch of 9/11 documents, totalling over 7,500 files. Additional document leaks containing “more secrets” and “more truth” have been promised, for a price.

The first batch of the supposed 18,000 documents was made available by the hackers at the weekend, along with a decryption key for ‘layer 1’ of the dump. The documents are believed to have been stolen from insurance companies, law firms and government agencies, and the hackers originally demanded an unspecified bitcoin ransom to keep them unreleased.

After apparently failing to secure the ransom, the group then took bitcoin donations from the public, releasing ‘layer 1’ after collecting $12,000 – but then also releasing ‘layer 2’ on Wednesday despite not meeting its funding target.

So far, no ‘smoking gun’ has emerged detailing conspiracy or government involvement in the terrorist attacks.

Instead, the documents build up a picture of insurance litigators brainstorming to see who they could sue for damages in the wake of the attacks. In emails, the lawyers discuss targeting the airlines, airplane manufacturers, the Federal Aviation Authority, the terrorists themselves, and foreign entities.

Talking strategy, the lawyers mull taking action against Boeing for not fitting the 757 and 767 aircraft used in the attacks with automatic transponders, which could have alerted authorities sooner that something was amiss, a case that the lawyers admit in the documents was flimsy. The lawyers also discuss dropping a case against the FAA, for fear of rankling the government.

Along the way, the litigators discuss whether then-President George W. Bush had advance knowledge of the attacks, or whether the Saudi Royal family was responsible, but this discussion is speculative and no damning new information is revealed.

While the encryption key for the first batch of documents has been scrubbed from Reddit, Pastebin and Twitter, it remained available for several days on Steemit. Dark Overlord’s account was banned from the platform on Wednesday, however, but the documents can be accessed on Busy.org, a website that runs on the same blockchain as Steemit.

The hacker group has promised three more layers of documents to come, if its price is met. The latest leak was accompanied with the message: “Continue to keep the bitcoins flowing, and we’ll continue to keep the truth flowing.” The hackers are asking for $2 million in bitcoin for the public release of its “megaleak,” which it has dubbed “the 9/11 Papers.”

Emerging in 2016, Dark Overlord has been responsible for numerous hacking and extortion schemes. The group infamously leaked an entire season of Netflix’s Orange is the New Black last year when its ransom was not met. When not leaking government and corporate documents, the group makes a living selling credit card information and medical records.

The group may have a hard time paying its members if the latest ransom demands are not met, however. Cyberscoop reported on Tuesday that the group was posting recruitment ads on dark web forums in November, looking to hire four skilled cybercriminals.

New employees were reportedly promised 50,000 pounds ($63,500) monthly, bumped up to 70,000 pounds ($89,000) after two years’ service.

Yellow Vest protesters are planning another demonstration, this time outside the Rothschild Bank of Lyon, France.

A Facebook event reveals over 3,000 French Yellow Vest protesters have expressed interest in attending a protest at the Rothschild Bank of Lyon, France, due in part to a 40-year-old grievance with France’s private banking system.

The event description explains that “The [French] state borrows from private banks, digs debt,” allowing the private banks to make money from interest loans made to the French government.

In 1973, after intense lobbying from the Rothschild Bank of France, French President George Pompidou signed legislation preventing the government from taking 0 percent interest loans from the Bank of France, the country’s central bank. Instead, the Bank of France is required to loan money to private banks, such as the Rothschild Bank of France, which can then lend money to the French government with interest.

In 1973, France did not have a debt problem and the national budget was balanced. Indeed, the state could borrow directly from the Bank of France to finance the building of schools, road infrastructure, ports, airlines, hospitals and cultural centers, something that it was possible to do without being required to pay an exorbitant interest rate. Thus, the government rarely found itself in debt. Nonetheless, on January 3, 1973, the government of President George Pompidou — Pompidou was himself a former general director of the Rothschild Bank — influenced by the financial sector, adopted Law no.73/7 focusing on the Bank of France. It was nicknamed the “Rothschild law” because of the intense lobbying by the banking sector which favored its adoption. Formulated by Olivier Wormser, Governor of the Bank of France, and Valéry Giscard d’Estaing, then Minister of the Economy and Finance, it stipulates in Article 25, that “the State can no longer demand discounted loans from the Bank of France.”

Many of the Yellow Vest protesters point to this legislation as the cause of France’s swelling public debt. Since 1980, France’s public debt expanded from a historic low of 56.17 percent of France’s Gross Domestic Product to 97 percent in 2017.

“Very good initiative,” one protester wrote on Facebook, “Finally we protest the real debt managers and not their puppets.”

The protest, titled “Les Gilets Jaune Bloque La Banque Rothschild de Lyon”, is scheduled for Tuesday, January 9.

Donald Trump Walks Out of White House Meeting with Chuck and Nancy ‘a total waste of time’

President Donald Trump walked out of a White House meeting with Senate Minority Leader Chuck Schumer and House Speaker Nancy Pelosi after they made it clear they were not willing to negotiate with Republicans to reopen the government and fund construction of a border wall.

“Just left a meeting with Chuck and Nancy, a total waste of time,” Trump wrote on Twitter.

Trump asked Nancy Pelosi if she would bring up a vote for border security within 30 days if he signed a bill to reopen the government.

According to Trump, Pelosi said, “No.”

“I said bye-bye, nothing else works!” Trump wrote.

Vice President Mike Pence noted that Democrats remained unwilling to negotiate a deal with the president and confirmed Trump’s account of the meeting.

“When she said no, the president said, ‘goodbye,’” Pence recalled.

Pence urged Americans to call their representatives to get them back to the table.

“The door here at the White House is wide open,” he said.

Congressional Republicans confirmed the account after the meeting, noting that Schumer and Pelosi refused to commit to any funding for a wall within 30 days, even if the government was reopened.

House Minority Leader Kevin McCarthy said that the president was in a good mood and wanted to make a deal with Democrats.

“He even brought a little candy for everybody,” he said.

But McCarthy said Pelosi refused to acknowledge the border crisis and that Schumer raised his voice while addressing the president.

“Their behavior is embarrassing to me,” McCarthy said, accusing them of lying about the nature of the meeting. He added that the media should bring their cameras into the next meetings so that everyone could see for themselves the nature of the conversations.

Pelosi and Schumer also spoke to reporters after the meeting.

“It’s cold out here and the temperature wasn’t much warmer in the Situation Room,” Pelosi said with a shiver, speaking to reporters outside the White House.

Schumer said that the president slammed the table in anger, a claim that Republicans disputed. Schumer said he felt like Trump’s behavior was “unbecoming of the presidency.”

Border authorities are referring 50 people a day for urgent medical care, including tuberculosis, flu and even pregnant women about to give birth, a top official said Monday, saying it’s unlike anything they’ve ever seen before.

Most of those in need of care are children, and a staggering 28 percent are under age 5, having been dragged along for the trip by parents who in many cases are hoping to use the children as a shield against speedy deportation from the U.S.

The numbers were released after a full review was done of all children in the custody of Customs and Border Protection in the wake of two illegal-immigrant children who died in U.S. hospitals in December.

CBP Commissioner Kevin McAleenan said most of those needing help were ill when they arrived at the border, and some appear to have made the initial decision to leave even while ailing.

“Many were ill before they departed their homes,” the commissioner said. “We’re talking about cases of pneumonia, tuberculosis, parasites. These are not things that developed urgently in a matter of days.”
