Shocking amendment to Green Light Law slipped into budget bill during virus crisis

New York State officials who provide information about illegal alien drivers to federal immigration enforcement agencies can now face felony charges.

An amendment to the highly controversial ‘Green Light Law,’ which went into effect in December and cleared illegal aliens to apply for New York State driver’s licenses, was slipped into the state’s 2020 budget bill and signed by Gov. Andrew Cuomo in April, in the midst of the coronavirus crisis.

It is now a Class E felony for state officials, such as law enforcement officers, to disclose DMV records with agencies such as Immigration and Customs Enforcement (ICE) or Customs and Border Protection (CBP).

“Border Patrol for example, working the highway in the middle of the night and pulls over a vehicle, they can’t run the plates to determine who owns that vehicle,” U.S. Attorney for the Western District of New York J.P. Kennedy told WKBW. “I think it’s legislating obstruction and it’s very concerning to me.”

“We’ve seen how important communication and coordination in coming up with a response to the pandemic and sort of causing people to work in isolation it’s a recipe for disaster,” Kennedy continued. “I’m very concerned about this and I think it’s very unfortunate and makes me really question the motives of the individuals that enacted this law, if their professed interest in public safety and public health is really as important as they say they are.”

Erie County Clerk Mickey Kearns says the new budget bill “basically criminalize[s]” police work.

“This is shocking. This is unheard of — and especially during a pandemic — that someone, the governor, who is under so much pressure, thought about that to put that in there.”

US Customs and Border Protection agents in South Texas are reportedly being given respirator face masks to deal with Chinese immigrants crossing illegally into the US through Mexico.

The agents, stationed in Texas’ Rio Grande Valley sector, on Tuesday said they’ve encountered 91 immigrants from China since start of 2020, according to Center for Immigration Studies fellow and counter-terrorism expert Todd Bensman.

Fortunately, none of the Chinese immigrants have tested positive for the Coronavirus currently wreaking havoc in China and other parts of the world.

The update from the southern border comes as US health officials on Tuesday warned the virus’ spread to the United States appears inevitable as cases continue to pop up in Asia and the Middle East.

“Ultimately, we expect we will see community spread in the United States,” a top scientist at the Centers for Disease Control and Prevention said Tuesday. “It’s not a question of if this will happen but when this will happen and how many people in this country will have severe illnesses.”

U.S. Customs and Border Protection (CBP) seized a package of dead birds from a passenger arriving from China at Dulles International Airport in Virginia, preventing what could have led to the spread of disease in people and domestic livestock.

“These dead birds are prohibited from importation to the United States as unprocessed birds pose a potentially significant disease threat to our nation’s poultry industries and more alarmingly to our citizens as potential vectors of avian influenza,” Casey Durst, director of field operations for CBP’s Baltimore Field Office, said in a press release.

“Customs and Border Protection agriculture specialists continue to exercise extraordinary vigilance every day in their fight to protect our nation’s agricultural and economic prosperity from invasive pests and animal diseases,” Durst said.

According to the press release:

The traveler arrived on a flight from Beijing, China January 27 and was destined to an address in Prince George’s County, Maryland. During a baggage examination, CBP agriculture specialists discovered a package with pictures of a cat and dog that the passenger said was cat food. The package contained a bunch of unknown small birds, about 2.5 to 3.5 inches in length.

The birds from China are prohibited for import due to the potential threat of highly pathogenic avian influenza.

The package with the dead birds were “destroyed by incineration,” according to authorities.

The U.S. Fish and Wildlife Service (USFWS), U.S. Department of Agriculture’s Animal and Plant Health Inspection Service (USDA-APHIS), and the Centers for Disease Control and Prevention (CDC) regulate animal and animal importation.

2020 presidential candidate Sen. Bernie Sanders is calling for the breakup of Immigration Customs Enforcement (ICE) and Customs and Border Patrol (CBP) in a new immigration plan out Thursday.

“Critics from across the political spectrum have documented the dysfunction and unaccountability of DHS, and President Trump has turned Customs and Border Protection (CBP) and Immigration and Customs Enforcement (ICE) into a renegade detention and deportation force. Immigration is not a threat to national security. It is long past time we break up the Department of Homeland Security and refocus its mission on keeping our country safe and responding effectively to emergencies.”

Why it matters: The plan positions Sanders further to the left on immigration than most, if not all, of his competitors seeking the Democratic nomination.

Details: Sanders’ plan would significantly restructure the Department of Homeland Security — which he claims “suffers from wasteful spending, bureaucratic bloat, and no clearly defined mission” — in part by distributing ICE’s border enforcement and deportation responsibilities to the Department of Justice.

  • Naturalization and citizenship services would go to the State Department, while the Treasury Department would assume the customs authority of CBP.
  • Sanders calls for a legislative pathway to citizenship for America’s 11 million undocumented immigrants and for border crossings to be decriminalized.
  • Sanders’ plan would also seek to expand the Obama-era Deferred Action for Childhood Arrivals program, known as DACA, and use “every executive tool available to remove barriers to legal permanent residence and naturalization” for participants.

Border Patrol footage shows the difference one administration makes

U.S. Customs and Border Protection (CBP) unveiled 60 miles of new border wall near San Luis, Arizona on Saturday, showing before and after footage of the location.

In the “before” footage, dozens of illegals can be seen running into the United States, and in the “after” footage, a “triple-layered enforcement zone which includes an 18’ bollard wall” occupies the same space.

According to CBP, the Trump administration plans on building over 400 miles of wall in California, Arizona, New Mexico and Texas by 2020.

“CBP has constructed over 60 miles of new border wall system along the SW border since 2017 and expects to complete 450 miles by the end of 2020.”

U.S. Border Patrol Chief Carla Provost tweeted out a time-lapse of the San Luis portion of the border wall being built, saying, “This new system improves impedance & denial of illegal entries, making the border safer for both my agents, & our nation.”

More Than 2,000 People In ICE Custody QUARANTINED In Outbeak Of Infectious Diseases

Immigrations and Customs Enforcement officers say that more than two thousand illegal immigrants, currently being held in ICE custody, are quarantined for exhibiting signs of infectious diseases, including the mumps.

CNN reports that the number of asylum seekers and other immigrant detainees, being held along the border in towns like El Paso, Texas, has spiked since last year, and that ICE and United States Customs and Border Protection are dealing with more seriously ill immigrants than every before.

“As of March 7, 2019, there was a total of 2,287 detainees cohorted for exposure to a detainee with a contagious condition,” an ICE spokesman said in a statement to media made earlier this week.

“In the past 12 months, there have been health investigations at 51 ICE detention facilities for mumps, chickenpox and influenza, according to [ICE officials],” CNN reports. “There have been 236 reported cases of mumps, with another 16 suspected cases during this time period.”

At least three children have died in CBP custody since November, after contrating life-threatening illnesses and infections on their journey north to the United States-Mexico border from their homes in Honduras or Guatemala. In at least two cases, border patrol tried to provide emergency medical care but they were simply too late; the childrens’ illnesses had advanced too far.

American immigration authorities are used to illegal immigrants and asylum seekers showing up to border patrol facilities exhibiting signs of illness, but over the past several years, most have eventually been disagnosed with influenza or the chicken pox — diseases that are still fairly common in the United States.

This past year, however, ICE and CBP officials have seen a major uptick in migrants with more serious, life-threatening illnesses, and dangerous communicable diseases like the mumps, which is spread through contact with bodily fluids and which could begin an outbreak among Americans if infected people are allowed to enter the general population.

The most serious outbreak has been in Texas, where around 200 people, aged 13-66, in a single border patrol facility are currently under quarantine for the mumps.

The situation poses problems not just for Americans, but also for migrants, and for the border patrol, whose facilities can’t withstand an influx of illegal immigrants with serious medical issues.

The New York Times reports that border facilities are already woefully understaffed to handle the sharp increase in asylum seekers — border patrol can now see up to 2,000 people crossing the border per day — and the facilities lag even further behind when called upon to handle hundreds of patients with life-threatening illnesses.

Border patrol knows the situation is critical, and is expected to announce major medical facility expansions “in the coming days,” the NYT says, and the Trump Administration is looking for a major health care provider to contract with the CBP to provide medical services — a contract they may be willing to pay more than $47 million to complete.

But the problem is that Border Protection isn’t a “humanitarian agency,” and isn’t supposed to be handling major disease outbreaks, leaving it at a loss for what to do about the thousands of criticially ill migrants who are showing up at the border every month.

76K Migrants Entered Through Southwest Border in February — Most in 12 Years, Says CBP

U.S. Customs and Border Patrol (CBP) reports that 76,103 migrants appeared at ports of entry and illegally crossed between ports in February. This is the largest number of apprehensions and inadmissible migrants for a February reporting period in 12 years, CBP stated Tuesday.

Of the 76,103 migrants who came to the border seeking admission or illegally crossing between ports of entry, 62 percent were family units and unaccompanied minors. This presents both a border security and humanitarian crisis at our southwest border, U.S. Customs and Border Protection Commissioner Kevin K. McAleenan said in a press conference on Tuesday afternoon.

United States Border Patrol Chief of Operations Brian Hastings told reporters that during February, Border Patrol agents apprehended more than 66,000 migrants who illegally crossed the border from Mexico between ports of entry. This is up from nearly 48,000 in January — a nearly 40 percent increase. When compared to the first five months of Fiscal Year 2018, this fiscal year has seen a 97 percent increase, he stated.

“A lot of folks look at that and they say, ‘we have seen numbers like that in the past,” Hastings explained. He said that many people do not understand the “significant change in the demographics of what we are seeing today is what presents us and our partners with a lot of challenges.”

The Border Patrol operations chief said that historically, agents have apprehended about 70 to 90 percent Mexican nationals. “We could apply a consequence to that demographic,” he stated. “We could return them quickly to Mexico.”

“Today, 70 percent of all of those we are arresting are from the (Central American) northern triangle — Guatemala, El Salvador, and Honduras,” Hastings continued. He explained that under current laws and court rulings there is no consequence to these migrants and they are nearly all released into the U.S. for an indefinite period of time.

“Without being able to deliver a consequence to these individuals for crossing our border, the Border Patrol has no reason to expect that this trend will decrease — in fact, we believe it will increase,” he surmised. “It’s well known at this time that immigrants with children will not be detained during the immigration proceedings. The word of mouth and social media quickly gets back to those in the northern triangle countries that ‘If you bring a child, you’ll be successful.”

Due to these circumstances, the number of cases of people falsely claiming to be family units has increased substantially. “From April 2018 through February 2019 we have had almost 2,400 fraudulent claims of families,” the operations chief explained. “Of those fraudulent claims, some are people who claim they are under 18 and they’re not. Others have actually been fraudulent familial claims.”

So far this fiscal year, Border Patrol agents apprehended 136,150 migrants claiming to be family units and 26,937 people claiming to be unaccompanied minors, according to the February Southwest Border Migration Report released Tuesday afternoon. This is a total of 163,087 family unit aliens (FMUA) and unaccompanied minors so far this year. In all of Fiscal Year 2018, Border Patrol agents only apprehended 157,248, the 2018 Southwest Border Migration Report stated.

Hastings and Commissioner McAleenan explained that these demographics present substantial challenges for the Border Patrol and CBP. In addition to the demographics, they explained that transnational criminal organizations (Mexican cartels) are shifting the crossing points to the most remote areas of the El Paso, Tucson, and Yuma Border Patrol Sectors and are crossing them in much larger groups in order to tie up Border Patrol resources.

The El Paso Sector witnessed a 1,697 percent increase in the number of family units apprehended in remote areas like the Antelope Wells crossing area. The Yuma and Tucson Sectors have both witnessed increases in excess of 230 percent. Other unsecured areas of the border including the Del Rio Sector in Texas saw an increase of nearly 400 percent over the previous February.

Commissioner McAleenan announced the formation of a new migrant processing center for the El Paso Sector to “provide one location for the processing of family units and children.”

The commissioner cautioned that the new facilities for processing migrants “will assist with managing the increased flows … The fact is that these solutions are temporary and this situation is not sustainable. Remote locations of the United States border are not safe places to cross and they are not places to seek medical care.”

Border Patrol agents in South Texas reportedly captured over 100 illegal aliens being trafficked in a single human smuggling event.

Video released by Customs and Border Protection (CBP) agents in the Rio Grande Valley sector shows a throng of illegals being corralled by agents during a nighttime bust.

“#BorderPatrol encounters over one hundred family units and unacommpanied children near McAllen, Texas in the #RGV Rio Grande Valley,” a caption for the video reads.

In a press release, CBP announced the bust was made by McAllen agents near the border town of Abram, Texas.

“Upon arrival, agents requested additional support for a group totaling over 100 subjects. Agents took custody of 113 illegal aliens, mainly comprised of family units and unaccompanied children from the countries of Honduras, Guatemala, El Salvador and Kosovo,” CBP reported.

“Border Patrol is processing the subjects accordingly.”

In another bust earlier this week, agents near Roma, Texas, captured two MS-13 gang members and two previously deported illegals who had committed child sex crimes.

The Rio Grande Valley sector has seen an increase in illegal crossings, amid news that a massive migrant caravan will soon be reaching the US.

Last week, we reported agents in South Texas arrested over 1,900 illegals in a single weekend.

Over the past few weeks, President Trump has stepped up pressure on Dems to approve funding for a wall on the southern border, which he says Mexico will pay for via the United States-Mexico-Canada Agreement, or USMCA.

Obama Used Tear Gas At Least 80 Times at Border

Under the Obama Administration, U.S. Customs and Border Protection (CBP) law enforcement officials, including Border Patrol agents, utilized tear gas against migrants at or near the border at least 80 times between FY2012 and early FY2017.

CBP officials reported the use of tear gas and pepper spray to push back “assaultive” caravan migrants attempting to enter the U.S. illegally on Sunday. The agency began using these particular sprays during the Obama administration in 2010.

Breitbart News confirmed the CBP began using tear gas (2-chlorobenzylidene malononitrile – CS) in 2010, though the available usage data initiates in FY2012.

The agency also reportedly began using pepper spray (Pava Capasaicin) at about the same time.

“CBP takes Sunday’s employment of use-of-force very seriously. CBP reviews and evaluates all uses of force incidents to ensure compliance with policy,” a CBP spokesman told Breitbart News in response to an inquiry. “Over 1,000 individuals who were part of the so-called caravan attempted to cross illegally into the U.S. by breaching sections of the fence and using vehicle lanes in and near the San Ysidro Port of Entry. This group ignored law enforcement agencies in Mexico and assaulted U.S. Federal Officers and Agents assigned to respond to the situation in San Diego.”

“As a response to the assaults and to defuse this dangerous situation, trained CBP personnel employed less-lethal devices to stop the actions of assaultive individuals attempting to break into the U.S.,” the spokesman continued. “CBP has been preparing for weeks for events like the one on Sunday. We have seen the use of violence by members of this so-called caravan who have attacked law enforcement personnel in Guatemala, Mexico and now the U.S. CBP will consider using all approved and available resources to protect travelers, caravan members, and our agents and officers.”

The CBP use of force reports show CS tear gas used 126 times since 2012. Officials utilized pepper spray a total of 540 times during that same period.

The current CBP Use of Force Policy handbook (dated May 2014) requires all officers and agents to be trained in the use of all weapons utilized in operations, including less than lethal devices, such as these types of sprays. It also requires the officers and agents to be exposed to the sprays as part of the course of instruction.

During a telephone conference call with news media on Monday, CBP Commissioner Kevin K. McAleenan said, “Yesterday, U.S. Customs and Border Protection agents and officers in San Diego effectively managed an extremely dangerous situation involving over 1,000 individuals who sought to enter the U.S. unlawfully in large groups. They did so safely and without any reported serious injuries on either side of the border.”

“As we’ve articulated for several weeks, we have been concerned about the size of the caravan, its primarily single-adult composition, and the aggressive and assaultive behavior at both the Honduras-Guatemala border and the Guatemala-Mexico border,” the commissioner continued. “U.S. government officials have noted the presence of criminals in the group, and the Government of Mexico has arrested over 1,000 caravan members for criminal violations in Mexico.”

“In the course of these events, individuals engaged in active assaults, throwing dozens of projectiles at CBP law enforcement personnel,” McAleenan explained. “Our Border Patrol agents were able to counter this activity, address the attempted group entry, and resolve the assaults with presence and less-lethal device deployments. Elements of the group then staged west of the port of entry and sought to press into the United States in the area of the Tijuana River channel. This group again became assaultive, with rocks and other projectiles thrown at our agents. Again, four agents were struck by projectiles in these assaults.”

Despite media reports to the contrary, CBP officers and agents operating under the Trump Administration responded the same way they did during the Obama Administration when, in 2013, migrants rushed the same stretch of border, Breitbart News’ Neil Munro reported.

Democrat congressional leaders and Hollywood activists teamed up to condemn the Trump Administration’s use of force in defending the border but ignored President Obama’s prior, identical response.

Pop star Rihanna accused the Trump Administration of “terrorism” for spraying tear gas at the border. Others called for the president’s impeachment over the clash.

Representative-elect Alexandria Ocasio-Cortez (D-NY) said the migrant caravan members are like the Jews fleeing the Holocaust, while Vermont Senator and possible 2020 presidential candidate Bernie Sanders called President Trump’s use of force “authoritarian.”
